| 内容記述 | [概要]情報化社会である現代，企業も大量の個人情報を取得し保有している。個人情報が漏えいしてしまうと，企業そのものだけではなく顧客やその家族，関係者にも多大な被害を及ぼしてしまう。本稿の取り扱う事例も，有名な会社による大規模な個人情報漏えい事件に関わる判決の一つである。裁判所は，個人情報の漏えいを「プライバシー権の侵害」として捉える。かかる「個人情報漏えいに基づくプライバシー権侵害」の問題につき，本件地裁判決，高裁判決，高裁判決それぞれが違う考え方をとっている。本稿は主に高裁判決に関して,これが何について結論を出したのか，また残された課題は何かについて，先例との比較を行いながら検討を行う。 [Abstract] In this information-oriented society, corporations gather much personal information. Leakage of personal information causes huge damage on corporations, customers, their families, and other people involved. Also in this case, so much personal information has leaked out of a corporation, which is very famous in Japan. The Court thinks leakage of information as invasion of privacy rights. About the problem of “invasion of privacy rights caused by leakage of personal information”, the Courts (the Kobe District Court, the Osaka High Court, and the Supreme Court) adopt different logic each. In this article the author focus mainly on judgement of Supreme Court, and examines “What this judgement refer about ?” and “What are the problems remained ?”, taking into account of past case law. |
