| 内容記述 | 研究成果の概要（和文): 本研究は, (1)行政上の義務の実現という行政代執行を含む行政上の強制執行の中核的要素が行政強制全体に係るコスト負担のあり方を巡る制度変革の影響を少なからず受けるということ, (2)義務者による自発的な義務履行の促進及びその権利保護の機会の確保に資する事前手続の行政代執行における「要素」としての重要性並びに(3)費用徴収手続が当該「要素」となり得ることを解明した. 研究成果の概要（英文): This study clarified (1) that realization of the administrative duty-in other words, a key component of administrative enforcement including the "Ersatzvornahme"-can feel the effect of reforming the system in order to share costs of the whole administrative enforcement, (2) the importance of the pre-procedure ,which contributes to promoting to fulfill the administrative duty spontaneous and to guaranteeing the chance of the legal remedy, as a "component" of the Ersatzvornahme, (3) and that the procedure for collecting costs can be the "component". | |||||||||
