| 内容記述 | 研究成果の概要（和文）：本研究では、EU各国の法制度の比較法研究を通じて、共同生活の経済的基盤に関する法制度（基礎的財産制）の意義と法実務の運用状況、夫婦財産の清算での公平性を確保するための法実務の運用状況を明らかにすることができた。とりわけ、日本の新しい夫婦財産制への提言のために、EU各国の共通項としてまとめられた「欧州家族法原則」とEU各国への影響をさらに検討する必要があることが明らかになった。研究成果の概要（英文）：In this study, the significance of the legal system on the economic basis of community life (general regal effects of marriage) and the operational status of the legal practice to ensure fairness in the liquidation of matrimonial property were clarified through a comparative study of the legal systems in EU countries. In particular, it has become clear that it is necessary to further examine the "Principles of European Family Law", which have been compiled as a common point for EU countries, and their implications for EU countries in order to make recommendations for a new matrimonial property system in Japan. | |||||||||
