| 内容記述 | 「中華人民共和国電子商取引法」が第13期全国人民代表大会常務委員会第5回会議で採択され、2019年1月1日に施行された。同法は電子商取引プラットフォーム事業者、プラットフォームを利用する消費者と電子商取引事業者の正当な権利と利益を保護し、市場の公正な競争秩序の維持を図り、電子商取引の健全な発展を促進する法体系を構成している。本稿は同法の内容について、競争政策としての側面、調整政策としての側面、振興政策としての側面、および消費者の権益、知的財産権の保護などの側面から考察し、その基本的特徴を検討する。 | |||||||||

| 内容記述 | The "Electronic Commerce Law of the People's Republic of China" was adopted at the 5th Session of the Standing Committee of the 13th National People's Congress and went into effect on January 1, 2019. The Law constitutes a legal framework to protect the legitimate rights and interests of e-commerce platform operators, platform-using consumers, and e-commerce businesses, maintain fair competitive order in the marketz, and promote the healthy development of e-commerce. This paper examines the content of this law in terms of its aspects as competition policy, coordination policy, promotion policy, and protection of consumers' rights and interests and intellectual property rights and examines its basic features. | |||||||||
