| 内容記述 | [要旨]本稿は国際的なマネー・ロンダリング防止―Anti Money Laundering regulation (AML)体制に関して，以下の4点について論じるものである。はじめに1980年代から顕著となった，マネー・ロンダリングの構造と，国際的AML体制の意義について纏めたい。次に，わが国におけるAML体制に関連する， 3つの法令，①犯罪収益移転防止法，②外国為替及び外国貿易法，③内国税の適正な課税の確保を図るための国外送金等に係る調書の提出等に関する法律に関して整理したい。 3つ目は，国際的AML体制に係る2つの大きな潮流，①前提犯罪の範囲拡大及び，②特定事業者の範囲拡大，について紹介したい。最後に，わが国AML体制のあるべき姿について検討したい。 [Abstract] In this study, I address four topics regarding international Anti Money Laundering (AML) regulation. First, I explain the structure of money laundering, which has become conspicuous since the 1980s, and the significance of international AML regulation. Second, I review the following three laws related to Japanese AML regulation: ⅰ.Act on Prevention of Transfer of Criminal Proceeds ⅱ. Foreign Exchange and Foreign Trade Act ⅲ. Act on Submission of Statement of Overseas Wire Transfers for Purpose of Securing Proper Domestic Taxation Third, I propose the following two major trends observed in recent international AML regulation: ⅰ. Expansion of a premise crime ⅱ. Expansion of a specific enterpriser Finally, I would like to identify the future direction of Japanese AML regulation. |
