| 内容記述 | [概要] 公開型投資信託のうち定期分配型投資信託の収益分配金の仕組みについて分析し, 投資元本の一部解約に伴う特別分配金の合法性について論じた。とくに, 投資信託法第4条(投資信託の締結)及び第19条(投資信託の解約等)は, 特別分配金が違法配当にならないための構成要件であり, 毎月分配型投資信託の仕組みの中心となる法規定である。一般消費者が毎月分配型投資信託を競って購入する背景と, 投資信託法の投資家保護の理念の不備について明らかにする。 [Abstract] A good many private investors buy today open-end investment trust from which these investors can receive monthly cash dividends. Why so ? This paper aims to analyze the open-end investment trust in Japan and to demonstrate against the dividend policy which consists of special distributions or extraordinary dividends by the return of paid in capital and dividends payable to private investors. |
