| 内容記述 | [概要] 憲法16条は, 基本的人権全体の総論的なものとして, 幸福追求権を示すと考えられる。 そして, 自由権,社会権, 平等権などの人権の大きなカテゴリーがあり, その下位概念として, 学問の自由, 信教の自由, 教育の自由などの人権カタログの1枚1枚が存在する。 これらのカテゴリーからはみ出る網羅的概念として, 「新しい権利」を承認し, 言語権をその中の一つであると考える。 言語権は, 「新しい権利」の一つとして承認されるべきであるが, 内容的には自由権, 教育権, 請求権的権利の有機的結合的人権である。 [Abstract] Article 16 of The Constitution of Japan speaks of the pursuit of happiness. There are rights of freedom, rights of equality, and rights of request, etc., As main categories, and freedom of religion, freedom of education, and academic freedom, etc., as subcategories. New fundamental human rights which extend beyond these categories should be recognized, and language rights are among of them. The contents of language rights, however, include rights of freedom, rights of education. Rights of request against the rights to petition the government. | |||||||||
