| 内容記述 | 本研究は、国連集団安全保障体制における人道的介入をめぐる様々な問題の中で、主に以下2つの側面を正面から扱った。第1は、保護する責任と体制転換の緊張関係である。これについては、2011年のリビアの体制転換のプロセスを実証的に検討する論文や、ミャンマーの軍事政権およびアフガニスタンのタリバン政権の政府承認をめぐる論文を発表した。第2は、人権侵害を助長する拒否権制限についてである。これに関しては、強行規範の観点からの拒否権の法的制限に関する論文や、ウクライナ情勢におけるロシアの拒否権行使の合法性と正統性に関する論文を公表した。 | |||||

| 内容記述 | The purpose of this study is to examine two important dimensions of humanitarian intervention under the United Nations Collective Security System. First, it foceses on the dilenmma between Responsibility to Protect (R2P) and regime change, with particular emphasis on the fall of Qadaffi regime in Libya in 2011. It also analyses the issue of governmental regognition in cases of Myanmar and Afghanistan in 2021, respsctively. Second, this study delves into the limitations of the use of veto power of the five permanent members in the UN Security Council in mass atrocity situations. It focuses on the legality of such a use of veto in light of the jus cogens norms. It also examines the legality and legitimacy of the Russian vetoes in the recent Ukraine Conflict. | |||||
