| 内容記述 | 本研究では、欧州各国の共同生活の経済的基盤に関する法制度（基礎的財産制）の比較法研究を通じて、基礎的財産制の意義と法実務の運用状況を明らかにすることができた。欧州諸国での基礎的財産制の伝統的な議論を整理しつつ、基礎的財産制の歴史的な意義やその役割、さらに同制度を今後どのように位置づけようとしているのかを解明することで、日本での基礎的財産制の具体的な制度内容の提言のための足掛かりを得ることができた。また、欧州各国の共通項としてまとめられた「欧州家族法原則」と欧州各国への影響、各国の国内法の議論にどのような影響を与えているのか、さらに検討する必要があることが明らかになった。 | |||||||||

| 内容記述 | In this study,through comparative legal research on the legal system concerning the economic basis of community life (general regal effects of marriage) in European countries , this study was able to clarify the significance of the general regal effects of marriage system and its operation in legal practice. In particular, we examined the historical evolution and contemporary significance of the general regal effects of marriage system. It also became clear that there is a need to further examine the "European Family Law Principles" that were compiled as a common denominator for European countries, their impact on European countries, and how they influence the discussion of domestic law in each country. | |||||||||
