| 内容記述 | [Abstract] What does the Judge hand down a decision with as a criterion? Japanese Constitution Art.76 III provided that the Judge is bounded "only law and conscience". However, it is requested to follow the past same kind of judicial precedent that Supreme Court gave as a practical matter. I consider what kind of influence "Stare Decisis" has on a judge and the nation of a side taking a trial by this report. | |||||||||
